In 2024, the state of New York made significant updates to its Property Condition Disclosure Act (PCDA), which governs the disclosure requirements for residential real estate transactions. One of the key changes is the elimination of the $500 credit that sellers previously had the option to provide to buyers in lieu of completing a Property Condition Disclosure Statement (PCDS).

This means that sellers are now required to provide a PCDS, which outlines the known condition of the property, to buyers prior to the sale. Additionally, the amended PCDA has added new questions to the PCDS, requiring sellers to disclose more detailed information about the property’s condition, including the presence of any standing water, the status of the home’s electrical and plumbing systems, and any known issues with the roof or foundation. 

While the PCDS is intended to provide buyers with more comprehensive information about the property they’re considering purchasing, it’s important to note that it is not a substitute for a professional home inspection. A Pre-Listing inspection will provide the seller with the information they need to accurately and honestly complete this form. 


In the current real estate market, it may be tempting for home buyers to waive the home inspection in an effort to make their offer more appealing. However, this is a risky decision that can have serious consequences, especially in light of the recent updates to New York’s Property Condition Disclosure Act. By obtaining a comprehensive home inspection, buyers can ensure that they’re making an informed decision about the property they’re purchasing and avoid potentially costly surprises down the line.
